China Mobile video service for HK

December 11, 2012: State-owned China Mobile has launched a mobile television service in Hong Kong for any phone users regardless of their carrier.

The application provides both free and paid channels on Android tablets and smartphones.

But iPhone users will have to wait until next year to get the app.

Known as UTV, the service offers free entertainment content including user-generated videos, a 24-hour news service provided by TVB and the UOne channel, created by China Mobile providing entertainment as well as food, travel, culture and technology programs.

Paid packages of HK$58 a month give users access to content including MNC International, Mei Ah HD Movie Channel, channel M HD, Nat Geo Wild HD, Star Chinese Channel, Cartoon Network and MNC international.

Malaysian TV ad regs to be tougher

13 December 2012, KUALA LUMPUR: The Information, Communications and Culture Ministry is in the process of strengthening the existing regulations on television advertisements to ensure a more effective monitoring.

Its deputy minister, Datuk Joseph Salang, said the requirement for advertisements to be issued with the made-in Malaysia (MIM) certificate to be aired on television was still applicable.

“This certificate is only issued for advertisements produced by local advertising producers.

“Foreign-made advertisement can only be used as foreign footage, but should not take more than 30 per cent of the advertisements to be aired,” he said when winding-up the debate on the Supply Bill 2013 in the Dewan Negara Thursday.

Salang also said the question of unfair division in the performance slot at Istana Budaya should not arise as the matter had been set, with 70 per cent for local artistes, and the remaining for international artistes, every year.

Yves Bigot appointed new CEO of TV5MONDE

(December 5, 2012) The Board* of TV5MONDE has today appointed Yves Bigot as the new Chief Executive Officer of the French language network after extensive consultations between its founding and shareholding governments**. Yves Bigot takes over from Marie-Christine Saragosse, who was appointed on October 7 Chairwoman and Chief Executive Officer for the holding company gathering the assets of the French government in French media broadcasting abroad, Audiovisuel Extérieur de la France.

Bigot was born in Limoges, France in 1955 and has made a career in the world of media and journalism since 1973 as a journalist, presenter, director, scheduler and producer for television, radio and the written press.

His past tenures include top management positions at music label Phonogram (now Mercury) from 1994-1997, French public TV broadcaster France2 from 1998-2005, Belgian public TV broadcaster RTBF from 2006-2008 and Endemol from 2008-2010.

Since August 2010, Bigot had been Managing Director for RTL.

Indian MSOs, LCOs facing anti-monopoly regs

(13 December 2012) MUMBAI: There could soon be caps on market shares of multi-system operators (MSOs) and local cable operators (LCOs) in a city, district, state and the country.

The Information and Broadcasting (I&B) Ministry is keen that competition emerges in some states where monopolies have got created in the absence of any market share regulations and such monopolies do not form in other states, through reasonable restrictions on MSOs and LCOs.

The Information and Broadcasting (I&B) Ministry on Thursday asked the Telecom Regulatory Authority of India (Trai) for its views on imposing of restrictions to prevent monopolies and the measures to prevent monopolistic operations by MSOs and LCOs.

Indon push-back on pay piracy

BANDUNG – The laws on piracy and illegal cable broadcasts have ensnared Sujiono, the owner of PT Mandala Haji Vision. His case has now progressed to the level of the High Court, as the West Java Prosecutor’s Office continues the legal process. An appearance of the suspect along with his case file was held on Thursday 11/10, in the High Court of Bandung.

The West Java Police have accused Sujiono with piracy and illegal cable TV broadcasts. He is alleged to have violated Law No. 19 (Year 2002) on Copyright, by distributing a channel / channels re-broadcast without permission from the official broadcast pay TV operators in Indonesia. The suspect was also charged with violating Law No. 32 (Year 2002) on Broadcasting, because it does not have a broadcast license.

Responding to the course of these proceedings, the Association of Multimedia Indonesia (APMI) expressed appreciation for the performance law enforcement officers in West Java. Speaking for the subscription television industry, the Association declared this to be a very good effort in law enforcement, especially relating to the Copyright Act and the Broadcasting Act.

“We strongly support and encourage the continued efforts of law enforcement like this. The legal process should continue against those who have broken the law and hurt the legitimate industry,” said APMI’s Legal Coordinator Handiomono to reporters on Thursday (11/10).

Handiomono said the legal action is a form of protection for the sustainability of the subscription television industry in Indonesia. He said the growth of illegal cable TV has been very high and is potentially detrimental to the authorized operators. “It certainly cannot be allowed that cable TV operators who operate illegally without a license, then hijack premium broadcast channels, which they redistribute for personal profit,” he said. Therefore, he said he hoped the High Court would work in a professional and transparent manner, following the laws that ensnared Mandala Haji Cable Vision.

According to Handiomono, Mandala Haji Vision is one of several cable TV network operators whose operations in West Java are substantially illegal. In addition to operating in the region of Cileunyi, Sujiono has also been expanding the company’s business up to Garut. “The number of recipients has reached more than 500 customers and it has lasted over a year,” he explained.

“We are optimistic that these legal proceedings will run in a transparent and professional manner. We hope that these proceedings will set a positive precedent and an example for similar law enforcement efforts in other parts of Indonesia,” said Handiomono.

Furthermore, he also noted, such proceedings also rely on the care and consideration of the Ministry of Communications and Information Technology in providing broadcasting license (IPP) to the (legal) cable TV operators.

For information, similar legal processes are already underway in other parts of Indonesia. In Bangka Belitung a piracy case concerning broadcasts by cable TV operators there have already entered the trial stage, while in Pare-Pare a cable TV operator has had his case sent to the courts by the police.

“I think the hotel has also become victims of pirate operators of this release. Thus the description of them would very significantly assist law enforcement in the disciplined cable TV industry in Batam,” he said.

Asians oppose new space protocol

Hong Kong, 13 December 2011 – CASBAA has joined the European Satellite Operators Association (ESOA), the Satellite Industry Association of (SIA) of the United States and the Space Industry Association of Australia (SIAA) to express urgent global concern over proposed new international legislation, the Space Assets Protocol, sponsored by the International Institute for the Unification of Private Law (UNIDROIT) based in Italy.

Meanwhile, some 90 satellite operators, manufacturers and financiers1 drawn from around the world have also written to UNIDROIT and its member governments to register their own deep-seated reservations.

According to CASBAA and the other international organizations, the UNIDROIT Space Assets Protocol would create an unprecedented and unnecessary legal framework for financing satellite and space programs despite the fact that no problems have been identified with the existing framework for funding commercial satellite programs.

Rather than promoting new financing, the proposed Protocol risks complicating and damaging the existing and well functioning processes. The industry would be confronted with the prospect of obligations and costs from the new legislation that purports to remedy a problem that simply does not exist.

“At a time when governments are urging industry to create more jobs to enable growth, if enacted, the legislation will place counter-productive burdens on the worldwide satellite industry”, said the chief executives of CASBAA, SIA, ESOA and SIAA2. “The additional bureaucracy will bog down procurement, reduce investment and result in the creation of fewer jobs in one of the most innovative and successful industries in the world.”

“We believe that the overwhelming opposition of the global industry should count for something in the priorities of our governments,” the four chief executives said. “We therefore urge all those with an interest in the continuing success of this sector to speak up and stop this process.”
