Discovery CEO: Streaming Services “Only Exist Because of Our Content”

7 Dec, 2015 – A week after the launch of Discovery’s TV Everywhere app, CEO David Zaslav took the stage on Monday at the UBS Global Media and Communications Conference in New York to tout the move into authenticated streaming and offer a word of caution about licensing content to standalone over-the-top platforms.

“We’re unique in that we own all of our content,” said Zaslav. “The best model is that we own it, and we own the relationship with the cable operator or direct-to-consumers. That doesn’t stop us from doing deals with other players, but you should expect that we’ll be rational.”

He added that he does not view all SVOD models as rational deals for Discovery’s business. “They only exist because of our content,” said Zaslav, noting that without licensed content many over-the-top platforms “are dumb pipes.” He continued: “We as an industry are supporting economic models that don’t make sense.”

HISTORY Greenlights Docu-drama ‘Barbarians Rising’

(7 December 2015, Singapore) – HISTORY has ordered “Barbarians Rising,” an eight-part docu-drama that reveals the true story of the 700-year struggle to bring down one of strongest empires the world has ever known. “Barbarians Rising” is a global co-production for HISTORY channels produced by October Films. This limited event series is slated to premiere in 2016 across 185+ territories.

“Barbarians Rising” tells the story of the rise and fall of the Roman Empire from the perspective of the barbarian rebel leaders. It is a visceral journey into the heart of a wave of rebellions against absolute power. The Roman Empire called them “barbarians” – tribes the Romans viewed beyond the fringe of civilization that lived a brutish and violent existence. However, these were also men and women who launched epic struggles that shaped the world to come.

“Barbarians Rising” features nine of history’s greatest warriors – Hannibal, who vowed a blood oath at the age of nine; Spartacus, the slave-turned-rebel who led a barbarian revolt; Boudica, the Celtic warrior Queen; Arminius, the stolen son of Germany; Attila, scourge of the east; as well as fighting units, the Goths, a fierce people betrayed by the empire; and the Vandals, the wandering raiders who dealt Rome’s final death blow. These monumental tales tell the story of how one of the world’s greatest Empires is undone by their aggressive quest for expansion.

“Barbarians Rising” is a global co-production for HISTORY channels produced by October Films. 一、版權條例的訂立,目的是保護每一個人的創作及表達自由,而並非限制。版權是上天賦予每一個人與生俱來的重要私有財產,每個人都有創作及表達自由,而版權本身是毋須登記,無論富或貧、大公司或小公司,創作出來的作品都會即時同樣平等地受到版權條例的保護,令大家可安心不斷創作和表達,免受抄襲盜竊的威脅。因此,面對新經濟和科技的挑戰,現時不少民主自由的國家,都不斷修訂《版權條例》,為國民的私有財產提供更完善及更有效的保障。

HK Legislature Urged: Move Now On Balanced Digital Copyright Bill

Hong Kong, 5 December 2015 – CASBAA today renewed its appeal to Hong Kong’s legislature to pass proposed amendments to the Copyright Ordinance when they come up for debate later this week. The amendments are critical to the future of the content industries in the SAR; they bring digital copyright principles to Hong Kong for the first time. “Hong Kong’s IP law is in dire need of updating,” said Chief Policy Officer John Medeiros, “in order to take account of legal and illegal digital distribution of copyrighted materials, including entire online packages of pirated pay-TV programming.”

Provisions to bring the digital world under reasonable and balanced copyright law have been debated for almost a decade in Hong Kong. (The SAR does not now have laws to implement its latest WIPO treaty commitments.) “While the laws are delayed, online piracy has flourished,” said Medeiros. “The lack of good laws in Hong Kong is causing huge damage to the creative industry. It is not theoretical; real jobs are being lost.”

The legislature next week will consider a series of more than 900 amendments to weaken the bill, and the “netizen” lobby is pushing for the bill’s defeat if their wishes aren’t met. For its part, CASBAA does not think the bill provides strong enough protection for copyrighted broadcasts, but on balance CASBAA prefers the bill be passed now, so that other issues – including the netizens’ proposed new exceptions as well as additional enforcement authority against commercial-scale piracy syndicates – can be considered in detailed consultations next year.

The bill has been dubbed an “Internet Article 23” by its detractors, confusing the public with the state security legislation in Hong Kong that was proposed, and then withdrawn, in 2003. “This nickname has become a distraction to the deliberation of the real issues in the bill,” Medeiros said. “Good copyright laws exist in all of the world’s leading democracies, and there is no contradiction between protecting creation of quality video programming, and basic civil rights.”

促請香港立法會通過更全面的電子版權法案

亞洲有線與衛星電視廣播協會(CASBAA,下稱「協會」)今日再次敦促香港立法會在本周稍後的會議上,通過對《版權條例》的建議修訂。該次修訂對香港特別行政區內容產業的未來尤關重要,將是香港歷來首次訂立數碼版權的相關原則。協會首席政策總裁馬德朗(John Medeiro)表示:「香港的知識產權法規亟需更新,以涵蓋通過合法與非法數碼渠道發布的內容,包括以整套形式於網上發布的盜版付費電視節目。」

在過去近十年間,針對監管數碼世界的版權,香港社會已進行多次廣泛辯論,以求制定合理並兼顧各方權益的版權法(香港特區目前尚未具備相應版權法例,以致無法履行世界知識產權組織(WIPO)版權條約的最新承諾)。馬德朗續道:「法例遲遲未立,盜版行為越見猖獗。一日法規未能完善,將繼續對創意工業帶來嚴重傷害,而這種傷害並非單是理論上的,而是確切令業界流失就業機會。」

立法會下周將審議針對條例草案的超過900項修訂,這一系列修訂目的不外為削弱草案效力;而與此同時,「網民」組織亦致力遊說各界,聲稱如要求未獲接納,將全力反對條例草案通過。以協會的立場來說,條例草案現時雖未能為廣播版權提供充足保障,然而綜觀全局,協會仍傾向草案能順利通過,好讓其他議題能於下年度的諮詢中詳細討論,包括網民提出的新增豁免範圍以及加強針對商業盜版集團的執法等。

《版權(修訂)條例草案》被反對者喻為「網絡23條」,令公眾將之與2003年提出並迅即撤回的國家安全條例草案互為混淆,正如馬德朗分析道:「該具誤導性的稱謂只會妨礙公眾探討草案背後的真正議題。事實上,全球所有民主體制都設有版權法,而保障優質節目製作與維護基本公民權利完全可以並存,兩者並無衝突。」

Hong Kong Copyright Alliance Urges Passage of Copyright (Amendment) Bill 2014

The Hong Kong Copyright Alliance urges the Legislative Council to endorse the Copyright (Amendment) Bill 2014 (“Bill”) to both bolster the freedom of expression and protect the creative sector from online piracy.

“The Bill not only ensures the freedom of expression, but also safeguards intellectual property rights. It is a lifeline for our ailing industry. It is a necessary measure allowing for the proper functioning of our economy in this age of new media and flawless mass digital transmission,” said Alliance convener Ms. Jenny Wong.

The Alliance, representing over 1,400 companies in the creative and entertainment industries in Hong Kong, believes the Bill represents a reasonable balance of interests among the stakeholders. The Bill will:

  • Safeguard the freedom of expression by providing sufficient exceptions that allow copyright users to continue to engage in creation of derivative works for such purposes as parody and quotation.
  • Offer practical guidelines for online service providers to handle alleged copyright infringement on their service platforms and establish a safe harbor that limits their liabilities in this regard.
  • Introduce a technology-neutral communication right to help protect the electronic communication of copyrighted works to the public against online piracy (e.g. commercial streaming pirate sites). It will plug a major loophole in the current provisions.
  • The public debate on the issues contained in the Bill started over a decade ago. The existing Copyright Ordinance is outdated and fails to provide an effective legal framework to tackle infringements in a new media environment.

    “The Bill is long overdue. Prolonging deliberation is not an option as infringing activities have threatened and continue to threaten the survival of much of our industries,” said Ms. Wong.

    The Copyright (Amendment) Bill 2014 will be tabled for resumption of second reading on 9 December 2015.

    Asia’s Got Talent Wins Best Adaptation at the Asian Television Awards

    SINGAPORE (December 4, 2015) – AXN Asia scored a major win with Asia’s Got Talent at the 20th Asian Television Awards last night, taking home the Best Adaptation of an Existing Format this year.
